Privacy Policy
This Privacy Policy covers how ReallyWho.com (we, us or our) treat personal information that we collect and receive at the ReallyWho.com website (the Website), including information related to your past use of our products and services. This Privacy Policy incorporates by reference the Terms of Use.
This Policy does not cover how we treat personal information we obtain from other sources, such as other websites, email or offline. This Policy also does not apply to the practices of companies that we do not own or control or to people that we do not employ or manage.
We don't rent or sell your information to anyone, period.
Information Collection and Use (General). We collect both Personal Information and Non-Personal Information, as defined below. We use collected information for the following general purposes: to fulfill your requests for products and services, improve our services, contact you, conduct research and provide information that is not personally identifiable for reporting to internal and external clients, organizations, professionals, contractors, investors and others.
If you register on the Website, we generally collect three types of Personal Information: Account Information, Profile Information and Verification Information, as described below. We also collect Non-Personal Information, such as browser logs, which does not contain Personal Information. If you do not register, we only collect the Non-Personal Information.
Personal Information is information about you that is personally identifiable, like your name, address, email address and phone number.
Non-Personal Information is the information we automatically receive and keep on our server generated by your browser, including your IP address, operating system, browser type, Internet service provider, website you came from, website you went to, our cookie information (if any), the page(s) you request, the date, time and duration of time spent on page(s) and the like in keeping with industry standard practice and standard browser technology. Non-Personal Information also includes aggregate and statistical information regarding how our Service is used.
Account Information is kept by us and is used for charges and includes name, address, phone, email and credit card information. Of the credit card information, we only keep the card type (Visa, MasterCard, Amex, etc.) and last four digits of the credit card information for customer service purposes. We use PayPal as our merchant credit card processor, and PayPal keeps your information on file in keeping with its arrangement with your credit card company.
Profile Information is kept by us and used for your ReallyWho Profile page and may include legal name, common name (alias or nickname), location, email, phone, job, school or university, short bio and picture. Only the legal name is required to be shown publicly on your Profile page. It is your option to show or not show the other Profile Information publicly on your Profile page.
Verification Information is NOT kept by us and is used only temporarily to search public records to generate identity questions (i.e., challenge questions) to which only you should know the answer, thereby verifying your identity. Identity verification information may include your legal name, common name (alias or nickname), date of birth, location, email and phone number.
We do NOT see or keep the public records used to generate the identity questions. The Verification Information is sent over the Internet via SSL encryption, or by voice to a customer service representative, to companies and agencies that provide access to the public and commercial records. They do not keep the Verification Information in a personally identifiable form after completing their service to us.
Information Collection and Use (Children). People of all ages can view the Verified Person profile information on the Website and can link to your Verified Websites. However, we do not allow children under age 18 to register for a ReallyWho account. We do not, nor do we allow links to websites that knowingly collect Personal Information from children under 18.
If you are a parent and suspect that your child has provided us with Personal Information, please notify us by going to the Contact Us area of the Website.
Information Sharing and Disclosure. We are not in the business of renting or selling Personal Information you provide on the Website with other people or non-affiliated companies. We may share your Personal Information only under the following circumstances:
- We may share your Personal Information with trusted partners and contractors who work with us and are covered under our confidentiality agreements to not share your information with others. These companies may use your Personal Information to help us provide the Service, perform identity or credential verification, or communicate to you our news, updates and offers.
- We may share aggregated Non-Personal Information with unrelated third parties such as the media, advertisers and government agencies. This aggregate information is typically in the form of statistics, such as number of users of the Website in a particular age group. Such aggregate information is not personally identifiable and is not traceable back to you as an individual.
- We may share your Personal Information as required by law, such as to respond to subpoenas, court orders and legal process, or to otherwise cooperate with law enforcement agencies or officials. We may also share your Personal Information to establish or exercise our legal rights or defend against legal claims.
- We may share your Personal Information if we believe it is necessary in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use or as otherwise required by law.
- We may share your Personal Information and Non-Personal Information if we are acquired by or merged with another company, in whole or in part. In this event, we will notify you before Personal Information is transferred and becomes subject to a different privacy policy.
Cookies. We set and access persistent and session cookies on your computer. A cookie is a small bit of information used by the Website to track your browser session. Most browsers are initially set up to accept cookies, but you can modify your browser settings to refuse (disable) all cookies or to indicate when a cookie is being sent, giving you the option to accept or reject the cookie. However, some of our features and services may not function properly if your cookies are disabled.
Modification of Information; Communications. You can edit your ReallyWho Account information at any time by logging in to the Website and selecting Settings, then the Account Tab. You can also edit your Profile Information on the Website at any time.
You may opt out of receiving our update and marketing materials by editing your notification preferences under your Account. Please note that even if you do opt out of receiving update and marketing materials, we reserve the right to send you infrequent non-marketing communications, such as service announcements and administrative messages that are considered part of maintaining your Website account.
Confidentiality and Security. We limit access to personal information about you to employees and contractors who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs. We will use reasonable security measures to protect against any unauthorized access to and disclosure of your personal information. However, please note that we cannot guarantee its absolute security.
Your Website account information is password protected. In certain areas, we use industry-standard SSL encryption to protect data transmissions.
Data you provide to us will be stored on our servers located either in our offices in North Carolina, or elsewhere in the United States. However, the Internet is worldwide and by providing us with your information, you understand and consent to the international transfer of your data to servers, routers and cables that may be in the United States or international locations.
You should take steps to protect yourself as well. For example, do not share your password or security question/answer with anyone else and take measures to prevent it from unauthorized access or disclosure, choose a password of more than 8 characters consisting of mixed case letters, numbers and symbols, and frequently change your password.

Changes to this Privacy Policy. This Policy is effective as of August 1, 2009. We may update this Policy at any time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your Website account or by placing a prominent notice on our Website.
